BijouTheater Terms of Use

BijouTheater is operated by Wintree Corporation, doing business publicly as Wintree Studios ("Wintree," "BijouTheater," "we," "us," or "our"). These Terms of Use govern your access to and use of BijouTheater.tv and related websites, streaming features, content, subscriptions, rentals, purchases, communications, and services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and Age Requirements

You must be legally capable of entering into a binding agreement to make a purchase, begin a subscription, or create an account. Users under 18 may use the Service only with the involvement and permission of a parent or legal guardian, where permitted by law. Age-restricted content may be viewed only by users who meet the applicable age requirement.

BijouTheater is not directed to children under 13, and children under 13 may not submit personal information through the Service.

2. The BijouTheater Service

BijouTheater may provide:

• Free, advertising-supported streaming
• Paid ad-free subscriptions
• Limited-duration rentals
• Digital access purchases for selected titles
• Live or scheduled programming
• Editorial articles, trailers, recommendations, newsletters, and promotional offers

The availability, pricing, features, and advertising status of programming may vary by title, device, location, distribution platform, and rights availability.

3. Limited License

Subject to these Terms, BijouTheater grants you a limited, personal, revocable, nonexclusive, nontransferable license to access and view the Service for private, noncommercial entertainment.

You may not:

• Copy, record, download, rebroadcast, distribute, publicly perform, sell, sublicense, or commercially exploit content except where BijouTheater expressly provides a permitted download or other written authorization
• Share paid access links, tokens, passwords, or account credentials outside your household
• Circumvent advertising, payment, geographic, security, digital-rights-management, or access-control systems
• Scrape, crawl, reverse engineer, interfere with, damage, or overload the Service
• Use the Service for unlawful, fraudulent, abusive, or infringing activity

No ownership interest in any film, program, article, image, software, or other content is transferred to you.

4. Accounts, Access Tokens, and Devices

Some features may use an account, payment receipt, browser cookie, local-storage token, access link, or third-party platform credential to recognize access rights.

You are responsible for protecting any credentials or access links provided to you. Clearing browser data, using private browsing, changing devices, or changing browsers may affect access under the current website system. Contact us if a valid paid entitlement is not recognized.

We may introduce or change account, authentication, and device-management features as the Service develops.

5. Subscriptions, Rentals, and Purchases

Subscriptions automatically renew until canceled, as explained in the BijouTheater Subscription Terms.

Rental access generally lasts 48 hours from the time of purchase unless a different period is shown at checkout.

A digital "purchase" provides a personal license to access the selected title through BijouTheater while we continue to have the legal right and technical ability to provide it. It does not transfer ownership of the title or guarantee that the title will remain available forever. We may remove or restrict content because of licensing changes, legal requirements, security concerns, platform changes, or other operational reasons.

Prices, taxes, promotional terms, and included features are shown at checkout and may change for future transactions.

6. Advertising

Free viewing may include advertising. Advertising may be supplied by BijouTheater or third-party advertising providers. The appearance of an advertisement does not necessarily mean that BijouTheater endorses the advertiser, product, or service.

Paid ad-free access removes advertisements inserted by BijouTheater on eligible web content. It may not remove sponsorships, product placement contained within programming, platform-level advertising, or advertising presented by an independent smart-TV or distribution platform.

7. Content Availability and Changes

Programming and features may be added, removed, delayed, edited, restricted, or made unavailable without notice. We do not guarantee that any particular title, genre, feature, trailer, article, or live stream will always be available.

Some titles may be unavailable in certain locations or on certain devices because of licensing or technical restrictions.

8. Third-Party Services

The Service may link to or rely on third parties, including Stripe, Cloudflare, smart-TV platforms, app stores, analytics providers, advertising providers, social networks, and external websites.

Third-party services operate under their own terms and privacy policies. BijouTheater is not responsible for an independent third party's services, content, availability, security, or practices.

9. Intellectual Property

The Service, including its design, software, logos, graphics, articles, compilations, and original materials, is owned by or licensed to Wintree Corporation and is protected by intellectual-property laws.

Films and other licensed programming remain the property of their respective rights holders.

10. Copyright Concerns

If you believe content on the Service infringes your copyright, send a written notice containing sufficient information to identify the copyrighted work, the allegedly infringing material, your contact information, a statement of good-faith belief, and a statement made under penalty of perjury that the information is accurate and that you are authorized to act.

11. Suspension and Termination

We may restrict, suspend, or terminate access when we reasonably believe a user has violated these Terms, misused the Service, shared unauthorized access, engaged in fraud, created security risk, or caused legal or operational harm.

Termination does not limit any rights or remedies available to us. Refund eligibility, if any, is governed by the Cancellation and Refund Policy and applicable law.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee uninterrupted operation, error-free playback, uninterrupted availability of any title, compatibility with every device, or that all metadata and editorial information will be free from error.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, Wintree Corporation and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Service.

For claims that cannot legally be excluded, our aggregate liability will not exceed the greater of the amount you paid directly to BijouTheater during the six months before the event giving rise to the claim or $100, except where applicable law requires otherwise.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Wintree Corporation and its affiliates, officers, employees, contractors, and licensors from claims, losses, liabilities, and expenses arising from your unlawful use of the Service, your infringement of another party's rights, or your material violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where the mandatory consumer laws of your place of residence apply.

Any court proceeding arising from these Terms will be brought in a court of competent jurisdiction serving McHenry County, Illinois, unless applicable law gives you the right to bring the proceeding elsewhere.

16. Changes to These Terms

We may update these Terms to reflect changes in the Service, pricing, technology, vendors, business practices, or legal requirements. The revised Terms will be posted with an updated date. Material changes may also be communicated through the Service or by email where appropriate.

Your continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
